Is this a real separation agreement? Will it hold up legally? +
ClearSplit produces a complete, properly structured separation agreement based on Canadian law. A separation agreement is a contract — it is legally binding when both parties sign it voluntarily, with full understanding, and with independent legal advice. ClearSplit strongly recommends both parties have a lawyer review the agreement before signing. The agreement references applicable statutes (Family Law Act, Divorce Act, Federal Child Support Guidelines) and is drafted in formal legal language. Courts recognize separation agreements as binding and will generally enforce them.
Do both parties need separate accounts? +
No. One party pays and creates the account. You share access — either sit together or share your login. The 90-day window gives both parties time to review, discuss, and revise. Your agreement is saved between sessions.
What happens after 90 days? +
Your account and agreement remain accessible to view and download, but editing is locked until you purchase a 30-day renewal for $74. There are no automatic renewals — you pay only when and if you need more editing time. Most couples complete their agreement well within 90 days.
Do we need to go to court to make this official? +
Not necessarily. A separation agreement is a private contract and does not require court approval to be valid and binding — as long as it meets the requirements under applicable provincial family law (e.g., in writing, signed, witnessed). If you are applying for a divorce, the agreement can be filed with the court as part of that process. Child support terms that deviate from the Federal Guidelines do require a judge's approval if they are to be incorporated into a court order.
We don't agree on everything — can we still use ClearSplit? +
ClearSplit works best when the two of you have general agreement on the major issues. It's also a useful tool for negotiation — you can use it to see what the Federal Guidelines say your child support should be, or what the SSAG suggests for spousal support, and use that as a starting point for your conversation. If there are significant unresolved disputes, mediation or legal counsel may be a better starting point.
Can I use ClearSplit if I'm not in Ontario? +
Yes. ClearSplit covers all Canadian provinces. Child support is federally governed (Federal Child Support Guidelines). Spousal support uses the SSAG, which is used nationally. Property division follows provincial law — ClearSplit's property section applies Ontario's Family Law Act by default but notes where provincial rules differ. If you are in BC, Alberta, or Quebec, review the property clauses carefully with a local lawyer.
