ClearSplit produces a draft separation agreement based on your inputs. Both parties should obtain independent legal advice before signing. This is not legal advice.
Enter the full legal names and contact information for both parties. These will appear on the signed agreement. Party A is typically the person initiating ClearSplit.
If there are no children under 18, skip this section. For each child, you'll set a parenting schedule and decision-making arrangement. The child's best interests govern all parenting decisions under the Children's Law Reform Act.
Child support is calculated under the Federal Child Support Guidelines. Enter both parties' gross annual incomes and ClearSplit will calculate the table amount. Deviations from the Guidelines require a judge's approval.
Section 7 expenses are shared in proportion to income and are in addition to table support. Common examples include childcare, medical/dental premiums, post-secondary tuition, and extraordinary extracurriculars.
Spousal support is discretionary and depends on length of relationship, income disparity, roles during the relationship, and economic hardship caused by separation. The SSAG provides a suggested range — not a fixed amount.
Under Ontario's Family Law Act, each spouse is entitled to equalization of net family property accumulated during the marriage. Enter key assets and debts — ClearSplit will calculate the equalization payment.
List any joint debts and which party assumes responsibility. Note: creditors are not bound by a separation agreement — both parties remain liable to the creditor even if one party agrees to assume the debt.
